terms

at a glance

• you keep ownership of everything you make. you give b3rri a license to run and improve the service, build new features and technology, and train and improve our own machine-learning models — see §7 and our Privacy Policy.
• voice rooms aren't recorded by default. recording requires consent from everyone in the room.
• payments go through apple. korean buyers keep their 7-day withdrawal right; EU buyers keep the 14-day CRD right, subject to the consumable-content exception.
• our total liability to you is capped at $100 as a single aggregate amount across all claims. statutory floors (death/injury, fraud, gross negligence, EU consumer law, KR 약관규제법 §7) override the cap where the law says so.
• US users agree to individual arbitration with a 30-day opt-out. korea and EU users keep their home-court protections.
• b3rri connects strangers: you're responsible for your own use and your interactions with other people, you use the service at your own risk, and you agree to cover (indemnify) us for claims that come out of your content or conduct. these summaries never override the mandatory consumer and data-protection law that applies to you.

1. agreement

you accept these terms when you create an account and use b3rri.

2. eligibility

you must be at least 13. higher where the law requires (16 in parts of the EU, 14 in parts of korea). you confirm you're not on a US, EU, UK, or korean sanctions list and that your use complies with export law. b3rri may not be available in every country.

3. accounts

sign-in uses OAuth 2.0 with PKCE through apple or google. keep your account information accurate. if we believe an account has been compromised we may suspend it until it's safe to restore.

4. using b3rri

b3rri is free to use. you're responsible for what you do on the service and for keeping your account secure. we may add, change, or remove features as the product evolves.

we don't promise permanent perks, founder badges, or rewards. if we introduce any, they'll ship with their own terms.

5. what's in the app

the app includes voice rooms matched by language pair, loopi (short vertical video), a photo feed, boards, chat, calls, follows and profiles, and in-app purchases. features will evolve.

third-party services

b3rri relies on third parties to work — apple and google for sign-in and in-app purchases, a real-time voice/video provider, a media CDN, push, and infrastructure operators. when you use a feature powered by a third party, that third party's terms and privacy practices also apply. we don't control third-party services and aren't responsible for them; enabling or relying on them is at your own risk, and if a third party changes or stops its service, the related b3rri feature may change or stop too.

6. acceptable use

b3rri is built around real-time voice, video, and text between strangers. trust is the whole product. the rules below apply to everything you say, send, upload, broadcast, or do on the service.

your responsibility for your content

you are solely responsible for everything you upload, post, publish, display, transmit, email, or otherwise make available on b3rri — text, data, software, music, sound, photos, graphics, video, messages, and any other material ("Content") — and for anything done under your account. b3rri may, at its sole discretion, investigate and take appropriate action against anyone who violates these terms, including removing the Content, suspending or terminating the account, and reporting to law enforcement. you agree not to use the service to post, email, or otherwise transmit Content that:

• is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, sexual, pornographic, libelous, invasive of another's privacy, or hateful or objectionable on racial, ethnic, or any other ground;
• infringes any patent, trademark, trade secret, copyright, or other intellectual-property or proprietary right of any party;
• is unsolicited or unauthorized advertising, promotional material, "junk mail," "spam," "chain letters," "pyramid schemes," giveaways, sweepstakes, or any other form of solicitation;
• contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any software, hardware, or communications equipment;
• in our sole judgment is objectionable, restricts or inhibits anyone else from using or enjoying the service, or may expose b3rri or its users to harm or liability of any kind;
• impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity;
• solicits personal information from anyone under 18;
• harvests or collects email addresses or other contact information of other users from the service, by electronic or other means, in order to send unsolicited communications;
• advertises or markets goods or services, a personal page, a social account or contact details, donations or sponsorship, or any form of solicitation, or posts repetitive Content of no real value or contrary to our community guidelines;
• interferes with or disrupts the service, or the servers or networks connected to it, or disobeys any requirement, procedure, policy, or regulation of networks connected to the service;
• violates any applicable local, state, national, or international law, or any regulation with the force of law;
• promotes criminal activity or enterprises, or provides instructional information about illegal activities;
• obtains or attempts to obtain, or accesses, any material or information by means not intentionally made available through the service.

the categories below spell out the most serious of these in detail; where they add specifics, the detail controls.

don't use b3rri to do anything illegal. specifically and without limitation, don't:

child safety

• post or share child sexual abuse material. zero tolerance. confirmed CSAM is reported to NCMEC and, where applicable, korean authorities, along with preserved evidence required by law.
• groom, sexualize, or endanger a minor in any way.

non-consensual sexual content

• share intimate or sexually explicit images, video, or recordings of another person without that person's express consent (including so-called "deepfake" sexual content).

harassment, stalking, doxxing, impersonation

• harass, threaten, stalk, bully, or coordinate pile-ons against any person.
• doxx — publish another person's private information (home address, phone number, government ID, financial account, location in real time) without their consent.
• impersonate any real person, organization, or b3rri staff, or operate inauthentic accounts.

hate, discrimination, and inflammatory content

we don't allow content that attacks, denigrates, mocks, ridicules, dehumanizes, or calls for harm against a person or group on the basis of a protected characteristic — including but not limited to:

political belief or affiliation, religion or faith (or lack of), race, ethnicity, national origin, language, caste, sex, gender, gender identity, gender expression, sexual orientation, disability, serious illness, age, body or appearance, refugee or migration status, social or economic status, and ideology.

specifically, and without weakening the general rule above, don't:

• post political smears, denigration, or attacks against any party, movement, candidate, public official, voter group, or their members. criticism of public policy or public figures' public acts is allowed; personal attacks on the basis of a protected characteristic are not.
• post religious mockery, blasphemy framed to incite hatred, or content that denigrates believers or non-believers of any faith. earnest theological disagreement is allowed; contempt-based attacks on a faith or its adherents are not.
• post ethnic, racial, or national slurs, jokes built on the dehumanization of any of the groups above, or coordinated brigading that targets users for who they are.

violence and extremism

• post content that glorifies, praises, organizes, recruits for, or fundraises for terrorism, violent extremism, mass violence, militias, or organized criminal groups.
• post graphic violence, gore, or injury for shock or entertainment, outside a clear news, educational, or documentary purpose.
• post specific, credible threats of violence against any person or group.

self-harm and suicide

• post content that promotes, encourages, glamorizes, instructs, or organizes self-harm, suicide, or eating-disorder behavior. (this rule is also a hard requirement under 정통망법 §44-7 in korea.)
• discussion, recovery, and help-seeking are welcome; promotion is not.

disinformation that causes real-world harm

• spread demonstrably false claims that endanger public health (vaccines, treatments, pandemics), public safety (disasters, evacuations), election integrity, financial markets, or that incite physical violence.
• opinion, satire, and parody are allowed; the rule targets false claims dressed as fact.

sexually explicit content and nudity

• post sexually explicit images, video, or live content. nudity in non-sexual contexts (art, breastfeeding, medical) follows separate in-app guidelines.

defamation

• knowingly make and spread false factual statements about an identifiable person or organization.

animal cruelty

• post or share content that depicts cruelty, torture, fighting, or staged harm to animals.

scams, fraud, deceptive monetization

• run spam, scams, "pump and dump" promotions, pyramid or MLM solicitations, fake-engagement or paid-follower schemes, phishing, or malware.
• misrepresent paid promotion as organic content.

intellectual property

• infringe anyone's copyright, trademark, patent, trade secret, or right of publicity. our full copyright takedown process is in our DMCA & copyright policy.

regulated and illegal goods

• traffic weapons, controlled substances or prescription drugs, gambling services where illegal, stolen goods, counterfeit items, or human trafficking in any form.

system abuse

• bypass safety, moderation, age-gate, geo-restriction, or rate-limit systems.
• scrape, crawl, mass-download, or automate the service outside published APIs.
• use the service to train AI/ML models without our prior written consent.
• attempt to compromise b3rri, other users, or third-party systems.

voice rooms — recording and consent

voice rooms are not recorded by default. you may not record, screen-capture, transcribe, or rebroadcast a room (or another participant's voice or video, or a 1:1 call) without the express, in-room consent of every person whose voice or image would be captured. local law may require even more.

safety and authenticity

to keep b3rri safe and to protect free expression, we remove accounts that harm the community — especially accounts that threaten the security of other accounts or of the service itself. we use a combination of automated and manual systems to detect, block, and remove accounts that continuously or blatantly break these terms or our community guidelines. our goal is that what you meet on b3rri is authentic: authenticity makes for a better place to learn and connect, and people who misrepresent who they are undermine that open environment.

in some cases we may ask an account for more information before we act — anything from a temporary limit to permanent deactivation. we assess accounts that misrepresent their identity against criteria that include:

• providing false personal information, or creating an account for someone else without their permission;
• using a name, user ID, nickname, or bio that doesn't follow our naming guidelines;
• using a profile photo that doesn't follow our photo guidelines — for example a company logo, or a photo of a politician or other public figure you are not;
• giving a false date of birth, or a nationality or native language that isn't yours (the native/learning-language pair is the core matching signal, so falsifying it degrades the service for everyone);
• one account that represents or is used by more than one person;
• one person operating multiple accounts, including to evade limits or enforcement;
• empty accounts left dormant for long periods;
• abusing our reporting system to harass others;
• misleading people about who owns or runs a profile in order to hide its real purpose.

disputes between users

you are solely responsible for your interactions with other people on b3rri, and you agree that b3rri is not responsible or liable for them. b3rri reserves the right, but has no obligation, to monitor or step into disputes between you and other users.

moderation and enforcement

moderation actions range from content removal to mute, restriction, suspension, and termination, and may include reports to law enforcement. for serious safety reports we aim for a first response within 24 hours; that's an aim, not an SLA. EU users can appeal under the DSA — see §15.

7. your content and the license you give us

you keep ownership of what you make on b3rri. your content is yours.

to provide and improve b3rri, you grant b3rri a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, modify (for example, transcode and reformat), create derivative works from (for example, thumbnails, previews, captions, translations, and audio summaries), display, perform, and distribute the content you upload, post, or share — to:

• operate, maintain, secure, and troubleshoot the service;
• improve the service and develop new features, products, and technology;
• promote the service (for example, featuring public content), where you haven't opted out; and
• develop, train, test, evaluate, and improve b3rri's own machine-learning models and algorithms — for example our language-matching, translation, captioning, recommendation, and trust-and-safety systems.

put simply: your content stays yours, and b3rri may use it to run and improve the service and to build and train our own models and algorithms. this license is limited to the purposes above, is exercised consistent with our Privacy Policy and applicable law, and does not let us sell your content. it does not override the voice-room rules in §6 — rooms and calls are not recorded by default, so we don't train on their audio or video unless recording happened with the in-room consent §6 requires. any use of special-category or biometric data, private messages, or the content of users we know to be minors happens only where the law and our Privacy Policy allow.

this license lasts as long as we host your content. it is irrevocable and perpetual for content you've already shared with other users (they keep their copies) and for anything already used to train or improve our models or algorithms — deleting your account doesn't untrain a model or claw back what other people received. to the fullest extent permitted by law, you waive any right to inspect, approve, or be paid for uses we make under this license, and you waive any moral rights in your content.

backups persist briefly after you delete. chat content remains accessible to its recipients. aggregated, anonymized, or de-identified data — and models or algorithms already trained — may persist after you delete your account.

you represent that you have the rights to grant this license for everything you upload, and that our use of it under this section won't infringe anyone's rights.

8. AI-assisted features

translation hints, captions, summaries, and similar AI-assisted features are assistive, not authoritative. don't rely on them for legal, medical, financial, safety, or immigration decisions.

AI outputs can be wrong, incomplete, or biased. you're responsible for how you use or share them, and anything you post that was AI-assisted counts as your content under §7 and must follow §6.

9. payments and in-app purchases

all paid features run through apple's billing. their terms also apply. subscriptions auto-renew unless you cancel at least 24 hours before the period ends. refunds are handled by the store.

• korea: for digital content, you have a 7-day withdrawal right under 전자상거래법 §17, except where consumption has begun with your express consent.
• EU/EEA: you have a 14-day withdrawal right under the Consumer Rights Directive, except where consumption has begun with your express acknowledgment that you lose that right (Art. 16(m)).
• taxes are calculated and remitted by the store.

apple app store

these terms are between you and B3RRI LLC, not apple. apple has no obligation to maintain or support the app. if the app fails to meet an applicable warranty, you may tell apple and apple may refund the purchase price; to the maximum extent permitted by law, apple has no other warranty obligation. apple isn't responsible for handling any claim about the app or your use of it — including product-liability, legal or regulatory, consumer-protection, or intellectual-property claims. you'll comply with apple's App Store terms and usage rules, and you confirm you aren't located in a country under a US embargo or on a US prohibited-party list. apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. premium and perks

any premium tier ships with its own terms and asks for fresh consent. if we change a paid offer, the change applies forward, not backward.

11. our intellectual property

B3RRI LLC owns the b3rri name, wordmark, the three-stylization, the design system, the software, and the APIs. you get a limited, non-exclusive, non-transferable, revocable license to use the service for personal, non-commercial purposes.

you may not copy, reverse engineer, or decompile the software, except where EU law guarantees interoperability rights you cannot waive. you may not scrape the service. you may not use our trademarks without written permission. you may not use b3rri content to train AI models.

feedback

if you send us ideas, suggestions, or feedback about b3rri, they're non-confidential, and you grant b3rri a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without attribution or compensation. don't send us anything you don't want us to use freely.

12. termination

you can delete your account at any time.

b3rri may suspend or terminate access for breach, safety risk, fraud, or abuse. we will tell you the reason where it's safe and lawful to do so.

sections that survive termination include the license you granted in §7 for content already shared with others or already used to train our models, IP (§11), disclaimers and the assumption-of-risk release (§13), liability and your indemnity (§14), region carve-outs (§15), governing law (§16), and general terms (§18).

13. disclaimers

to the maximum extent permitted by law, the service is provided as-is and as-available, without warranty of any kind.

statutory consumer protections in korea, the EU, the UK, and the US are not waived by this clause. where they apply, they apply.

assumption of risk

b3rri connects you with people you don't know, for live voice, video, and text. we don't verify anyone's identity, statements, age, or intentions, and we are not responsible for what other users say, share, or do. you meet people and act on what you find here at your own risk — use good judgment, and never send money or share financial or government-ID details based on trust you haven't earned offline.

to the fullest extent permitted by law, you release b3rri, B3RRI LLC, and our staff from any claim, demand, or damages arising out of a dispute with, or the acts or omissions of, another user or third party. if you are a california resident, you waive California Civil Code §1542, which says a general release does not extend to claims the releasing party does not know of at the time. this release does not apply where the law forbids it, including the statutory floors in §14.3.

14. liability

14.1 no indirect damages

to the maximum extent permitted by law, b3rri is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, even if we were warned that the loss was possible.

14.2 hard cap

IF b3rri IS LIABLE FOR ANY REASON, THIS LIABILITY SHALL BE LIMITED TO AN AMOUNT OF ONE HUNDRED US DOLLARS ($100).

this is a single aggregate cap across all of your claims, all theories (contract, tort, statute, restitution, anything else), and all time. it applies whether or not you paid us anything. it applies whether or not we were warned that loss was possible.

14.3 statutory floors that cannot be waived

§14.1 and §14.2 do not apply where the law forbids them. nothing in this section limits liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• gross negligence or willful misconduct (per korea 약관규제법 §7);
• rights you cannot waive under EU or UK consumer law (Consumer Rights Directive, Unfair Contract Terms Directive, Digital Content Directive);
• the EU Product Liability Directive;
• any non-waivable consumer right under US state law (including CA Civil Code §1668 for willful/gross-negligence claims).

if a court finds the $100 cap unenforceable for a category of claim, the cap still applies to every other claim, and is interpreted to give the maximum effect the law allows.

14.4 indemnification

to the fullest extent permitted by law, you will defend, indemnify, and hold harmless b3rri, B3RRI LLC, and our officers, staff, and agents from and against any third-party claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your content; (b) your use of the service; (c) your breach of these terms, of any law, or of a third party's rights; or (d) your interaction or dispute with another user. we may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you will cooperate with us.

this does not require you to indemnify us for our own fraud, gross negligence, or willful misconduct, and it does not apply to the extent a mandatory consumer-protection law (EU/UK, korea 약관규제법, or applicable US state law) limits or prohibits it.

15. region carve-outs

korea

korean consumer law applies to korean residents. that includes 약관규제법 (regulation of standard terms), 전자상거래법 (e-commerce consumer protection), and 정통망법 (information and communications network act). where mandatory rules don't displace it, the seoul central district court is the agreed venue.

EU, EEA, and UK

the Consumer Rights Directive, the Unfair Contract Terms Directive, and the Digital Content Directive (2019/770) apply where they do under your local law.

under the Digital Services Act we provide:

• an in-app and email mechanism to report illegal content.
• acknowledgment of receipt and a statement of reasons for any moderation decision affecting your content or account.
• access to a certified out-of-court dispute settlement body under Art. 21.
• the right to take the matter to your national court.
• statutory transparency reporting once we cross the relevant thresholds.

EU residents may bring proceedings in their country of residence.

united states

disputes are resolved by binding individual arbitration administered by JAMS under the JAMS Streamlined Arbitration Rules, in san francisco, california, in english. you waive class actions. you may opt out of arbitration within 30 days of accepting these terms by emailing [email protected] with the subject "Arbitration Opt-Out" — opting out doesn't change anything else in these terms.

small-claims court and IP injunctive relief are excluded from arbitration. CCPA/CPRA rights (see Privacy) are unaffected.

any claim you bring against b3rri must be filed within one year after it arises, or it is permanently barred — except where a longer period is guaranteed by mandatory law. this shortened period does not apply to korea, EU, EEA, or UK residents whose consumer law forbids it.

everywhere else

local mandatory consumer protection sits on top of these terms. nothing here removes a right your country gives you.

16. governing law

these terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law principles. subject to the arbitration agreement and the region carve-outs in §15, the state and federal courts in San Francisco County, California are the courts of first instance. §15 preserves the mandatory local law and home forums of users in korea, the EU, the EEA, the UK, and elsewhere — those are not displaced by this section.

17. changes

material changes take effect 30 days after notice by email and in-app banner, and require renewed consent where 약관규제법 §3 or EU law requires it. non-material changes take effect on posting.

18. general

these terms are the entire agreement on this subject. if any clause is unenforceable, the rest stands. failure to enforce a clause is not a waiver. you can't assign your account; we may assign these terms to an affiliate or successor. nothing here creates an agency or partnership. neither side is liable for force majeure events outside reasonable control. english controls, except where local mandatory law requires a translation. notices go to the email on your account, or to [email protected].
